Agreement Acceptance and Modifications

By accessing, registering for, or using QuestDaily services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and QuestDaily.

We reserve the right to modify these terms at any time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated through email notifications, in-app announcements, or prominent website notices at least 30 days before implementation.

Eligibility and Account Registration

QuestDaily services are available to individuals aged 13 and older. Users between 13-17 must have parental or guardian consent. By creating an account, you represent that you meet age requirements and have authority to enter into this agreement.

Account registration requires accurate, complete, and current information. You are responsible for maintaining account security, including password confidentiality and monitoring account activity. Notify us immediately of any unauthorized access or security breaches.

User Conduct and Community Standards

QuestDaily fosters a positive, inclusive gaming community. Users must treat others with respect, avoid harassment, discrimination, or abusive behavior, and contribute constructively to community discussions and activities.

Prohibited conduct includes but is not limited to: sharing inappropriate content, engaging in hate speech, threatening other users, impersonating individuals or entities, sharing personal information without consent, and disrupting platform functionality or other users' experiences.

Intellectual Property Rights and Licenses

QuestDaily and its licensors own all intellectual property rights in the platform, including software, graphics, text, audio, video, trademarks, and proprietary algorithms. Users receive a limited, non-exclusive, non-transferable license to access and use services for personal, non-commercial purposes.

User-generated content remains your property, but you grant QuestDaily a worldwide, royalty-free license to use, display, and distribute such content within our platform for service delivery and improvement purposes.

Virtual Items and Digital Economy

QuestDaily may offer virtual items, currencies, achievements, and rewards with no real-world monetary value. These digital assets are licensed for use within our platform only and cannot be transferred, sold, or exchanged outside our ecosystem.

We reserve the right to modify, suspend, or discontinue virtual items, adjust their properties or availability, and manage the digital economy to maintain game balance and user experience. Virtual items are forfeited upon account termination.

Payment Terms and Subscription Services

Premium subscriptions and paid services are billed according to selected plans with automatic renewal unless cancelled. All fees are non-refundable except as required by law or specified in our refund policy.

Payment processing is handled by secure third-party providers. You authorize us to charge your selected payment method for applicable fees, taxes, and charges. Failed payments may result in service suspension or account termination.

Service Availability and Modifications

While we strive for continuous service availability, QuestDaily may experience downtime for maintenance, updates, or technical issues. We do not guarantee uninterrupted access and are not liable for temporary service unavailability.

We reserve the right to modify, suspend, or discontinue services or features at any time with reasonable notice. Significant changes affecting paid services will include appropriate user notifications and transition periods.

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, incorporated by reference into these terms, explains how we collect, use, and protect your personal information. By using our services, you consent to data processing as described in our Privacy Policy.

We implement appropriate security measures to protect user data but cannot guarantee absolute security. Users are responsible for maintaining account security and promptly reporting any privacy concerns or data breaches.

Prohibited Activities and Enforcement

Users may not engage in activities that violate laws, infringe rights, compromise security, or disrupt services. Prohibited activities include hacking, cheating, using unauthorized software, creating multiple accounts to circumvent restrictions, and commercial use without permission.

Violations may result in warnings, temporary suspensions, permanent account termination, or legal action. We reserve the right to investigate violations, cooperate with law enforcement, and take appropriate protective measures.

Third-Party Services and Integrations

QuestDaily may integrate with third-party services, websites, or applications to enhance functionality. These integrations are governed by third-party terms and privacy policies, which users should review independently.

We are not responsible for third-party service availability, content, or practices. Users interact with third-party services at their own risk and should exercise appropriate caution when sharing information or making transactions.

Disclaimers and Limitation of Liability

QuestDaily services are provided "as is" without warranties of any kind, express or implied. We disclaim warranties of merchantability, fitness for particular purposes, and non-infringement to the fullest extent permitted by law.

Our liability for any claims related to services is limited to the amount paid by you in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages regardless of the legal theory.

Indemnification and Defense

You agree to indemnify, defend, and hold harmless QuestDaily, its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses arising from your use of services, violation of these terms, or infringement of third-party rights.

This indemnification obligation survives termination of your account and these terms. We reserve the right to assume exclusive defense of any matter subject to indemnification, and you agree to cooperate with our defense efforts.

Dispute Resolution and Arbitration

Most disputes can be resolved through our customer support channels. For unresolved disputes, you agree to binding arbitration administered by a recognized arbitration organization under applicable commercial arbitration rules.

Arbitration will be conducted individually, not as part of class or collective actions. This arbitration agreement does not preclude either party from seeking injunctive relief in court for intellectual property violations or other appropriate circumstances.

Termination and Account Closure

Either party may terminate this agreement at any time. You may close your account through account settings or by contacting customer support. We may suspend or terminate accounts for terms violations, extended inactivity, or business reasons.

Upon termination, your access to services ceases immediately, and we may delete account data according to our data retention policies. Provisions regarding intellectual property, indemnification, and dispute resolution survive termination.

Governing Law and Legal Compliance

These terms are governed by the laws of [Jurisdiction] without regard to conflict of law principles. Users agree to comply with all applicable local, state, national, and international laws and regulations while using our services.

If any provision of these terms is found unenforceable, the remaining provisions continue in full force and effect. Our failure to enforce any provision does not constitute a waiver of our rights to enforce such provision in the future.
